1. Acceptance of Terms

By downloading, installing, or using Pulseo ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Pulseo is a heart rate monitoring and health tracking application that provides:

Heart rate measurement using camera-based photoplethysmography (PPG)
Heart rate variability (PRV) analysis
Stress, energy, heart age, and heart score estimates
Manual health entry tracking (blood pressure, blood oxygen, blood glucose)
Step counting via Apple HealthKit integration
AI-powered wellness coaching (via on-device Apple Intelligence)
AI-powered food nutritional analysis (via on-device processing)
Medication reminders
Health data history and trend visualization

3. Medical Disclaimer

3.1 Not a Medical Device

Pulseo is NOT a medical device. The App is not intended to diagnose, treat, cure, or prevent any disease or health condition. The App has not received regulatory clearance from any health authority (FDA, CE, or equivalent).

3.2 Informational Purposes Only

All measurements, calculations, estimates, and AI-generated content provided by the App are for informational and educational purposes only. They should not be used as a substitute for professional medical advice, diagnosis, or treatment.

3.3 Measurement Accuracy

Heart rate measurements are performed using photoplethysmography (PPG) through the device's camera and flashlight. This consumer-grade method:

Provides estimates that may differ from clinical-grade medical devices
Can be affected by movement, ambient lighting, skin tone, finger placement, and device hardware
Should not be relied upon for critical medical decisions

3.4 Limitations

The App does NOT measure the following via the camera:

Blood pressure
Blood oxygen saturation (SpO2)
Blood glucose levels
Body temperature

These values can only be entered manually by the user. The App does not detect arrhythmias, heart attacks, atrial fibrillation, or any cardiac conditions.

3.5 Consult a Healthcare Professional

Always consult a qualified healthcare professional before making decisions about your health. Do not disregard professional medical advice or delay seeking medical attention because of information provided by the App.

In case of a medical emergency, call your local emergency number immediately.

4. AI-Generated Content Disclaimer

4.1 On-Device AI

AI features including wellness coaches (Heart Health Coach, Mental Wellness, Nutrition Coach, Sleep Coach) and food nutritional analysis are powered by Apple Intelligence (Foundation Models), which runs entirely on your device.

4.2 Not Professional Advice

AI-generated responses are for informational and educational purposes only. They do not constitute:

Medical advice or diagnosis
Nutritional or dietary prescriptions
Psychological counseling or therapy
Treatment recommendations

4.3 AI Accuracy

AI responses may contain inaccuracies, incomplete information, or inappropriate suggestions. The AI model is a general-purpose language model and is not a trained medical, nutrition, or psychology professional. Food nutritional analysis provides approximate estimates only.

5. Subscription Terms

5.1 Free Tier

The App offers a free tier with limited functionality:

Up to 3 heart rate measurements per day (Fast mode)
Basic BPM and PRV display
7-day trend history
Manual health entries
HealthKit integration
Step counter
Medication reminders
Limited AI interactions

5.2 Pulseo Plus (Paid Subscription)

Pulseo Plus unlocks additional features through an auto-renewable subscription:

Unlimited measurements
Advanced measurement mode (stress, energy, heart score, heart age)
Full PRV statistics
Complete history and trend charts
Unlimited AI specialist chats
Food nutritional analysis
Additional export capabilities

5.3 Subscription Management

Subscriptions are billed through your Apple ID account via the App Store
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions
No refunds are provided for partial subscription periods; cancellation takes effect at the end of the current billing period

5.4 Price Changes

We reserve the right to change subscription pricing. You will be notified of price changes in advance, and changes will apply only to future billing periods.

6. HealthKit Usage

6.1 Optional Integration

HealthKit integration is optional. The App functions fully without HealthKit access.

6.2 Permitted Use

HealthKit data is used exclusively for health and fitness purposes within the App:

Reading historical health data to display trends and insights
Writing measured heart rate and PRV values to Apple Health

6.3 Prohibited Use

In compliance with Apple's guidelines, HealthKit data is never used for:

Advertising or marketing
Data mining or profiling
Sale or transfer to third parties
Any purpose unrelated to health and fitness functionality

6.4 No Paywall

Basic HealthKit read and write functionality is available to all users, including free tier users, in compliance with Apple's App Store guidelines.

7. User Responsibilities

By using the App, you agree to:

Provide accurate profile information (age, gender, height, weight) for proper health calculations
Not rely solely on the App for medical decisions
Seek professional medical care when needed
Use the App in accordance with these Terms
Not attempt to reverse-engineer, modify, or redistribute the App

8. Intellectual Property

8.1 Ownership

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal Apple devices for personal, non-commercial purposes.

8.3 Restrictions

You may not:

Copy, modify, distribute, or create derivative works of the App
Reverse-engineer, decompile, or disassemble the App
Use the App for any commercial purpose without written permission
Remove or alter any copyright, trademark, or proprietary notices

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that:

Measurements or calculations will be accurate, complete, or reliable
AI-generated content will be correct, appropriate, or safe
The App will be uninterrupted, error-free, or free of harmful components
The App will meet your specific health or medical requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEOPLEPARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data or health information
Health decisions made based on App data or AI content
Physical harm or adverse health outcomes
Inaccurate measurements or calculations
Interruption of App services

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless PeoplePark, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Health decisions made based on information provided by the App
Your violation of any third-party rights

12. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://pulseo.peoplepark.app/privacy-pulseo and within the App at Settings > Privacy Policy.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, all licenses granted to you under these Terms will immediately cease. Sections 3, 9, 10, 11, and 14 survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PeoplePark is registered, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last Updated" date at the top of this document. Your continued use of the App after changes constitutes acceptance of the revised Terms.

For material changes, we will provide notice through the App or by other appropriate means.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
